Terms and Conditions

Your use of nahralhada.com, or making a booking with Nahr Al Hada Resort, constitutes your express agreement to these Terms and Conditions.

1.1 Service Provider Identity

1.2 Identification Upon Arrival

All adult guests must present a valid national ID, Iqama, or passport at check-in, and their data will be registered through the Shomos platform in compliance with security regulations.

1.3 Pricing and Tax

All prices displayed are in Saudi Riyals and include 15% Value Added Tax (VAT), unless otherwise stated.

1.4 Payment Methods and Installment Payment

  • All payments made through the website are processed via the approved online payment gateway, Tap (Tap Payments), whether by full immediate payment or through any other payment method enabled within it.
  • Among the payment methods available through the Tap gateway is the installment payment option via the Tabby service, which is a payment method enabled within the resort's account with Tap, and not an independent contracting party separate from the payment gateway.
  • When the guest chooses to pay in installments:
    • The booking is considered confirmed only after the installment payment request is approved and the transaction is successfully completed through the Tap gateway; if the request is declined or not completed, the booking is not confirmed and no payment is deducted.
    • The resort receives the full booking value upfront from the Tap gateway, in accordance with the standard settlement cycle agreed between the resort and Tap, regardless of the guest paying the installment provider in subsequent installments.
    • The contractual relationship governing the installment schedule, due dates, and any related fees or late penalties is exclusively between the guest and the installment service provider (Tabby). The resort is not a party to this relationship and bears no obligation or liability toward it in any capacity.
    • A guest's failure to meet any installment obligation owed to the installment provider has no effect on the confirmation of their stay or their right to the booked service, given that the resort has already received its full dues upfront from the payment gateway.
    • The "first-night payment" shown at the time of booking represents part of the total booking value settled through the Tap gateway, and is not an additional or separate deposit, nor does it create any right for the guest beyond what is set out in the Booking, Cancellation, and Refund Policy.
    • The guest acknowledges having reviewed and independently agreed to the installment provider's own terms and conditions when completing the installment request, and that the resort bears no responsibility for any dispute relating to those terms.

1.5 Stay Rules and Code of Conduct

  • The number of guests must not exceed the maximum capacity specified for the booked unit.
  • All guests must comply with public conduct regulations. Bringing, consuming, or promoting alcoholic beverages, narcotics, or psychotropic substances of any kind is strictly prohibited throughout the Kingdom of Saudi Arabia, and this prohibition is enforced within the resort without exception, with the relevant authorities notified immediately upon confirmation of any violation, without any liability on the resort's part.
  • The resort reserves the right to terminate the stay of any guest who violates public conduct rules or causes clear disturbance, without any obligation to refund any amount (including any amounts settled through the Tap gateway or any payment method enabled within it).
  • Booking or check-in for minors is not permitted without the accompaniment of an adult guardian.

1.6 Damages and Financial Liability

The primary booking holder bears full financial responsibility for any damage to, or loss of, the unit or its contents during the stay, which will be deducted from the security deposit specified in the Booking, Cancellation, and Refund Policy page, or claimed separately if needed. The resort is not liable for the loss of guests' personal belongings.

1.7 Intellectual Property

All website content (logo, images, text) is owned by Nahr Al Hada Vacation Homes Company, and may not be used without prior written permission.

1.8 Governing Law and Jurisdiction

These Terms are governed exclusively by the laws and regulations of the Kingdom of Saudi Arabia, and Saudi courts have exclusive jurisdiction over any dispute arising therefrom, without prejudice to the consumer's right to refer to the Ministry of Commerce or the Ministry of Tourism. Any dispute relating exclusively to payment processing or the installment terms themselves is governed by the guest's agreement with the payment gateway (Tap) and/or the installment service provider (Tabby) and their published terms and conditions, without the resort being a party to that contractual relationship.
